Data Protection Policy

Last updated: May 2026

Overview

Modern Education Australia ("Modern Edu", "we", "us") is committed to protecting personal information in accordance with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). This policy describes how we collect, hold, use, and disclose personal information, and the measures we take to keep it secure. This policy should be read alongside our Privacy Policy, which provides additional detail on the types of information we collect and how we use it.

What personal information we collect

We collect personal information that is reasonably necessary for our functions and activities. This includes identity information (name, email address, phone number), payment information (processed and stored by our third-party payment provider — we do not store full credit card numbers), learning data (course progress, assessment results, quiz responses, AI tutor interactions), account data (login credentials, account preferences), and technical data (IP address, browser type, device information, pages visited).

How we collect personal information

We collect personal information directly from you when you create an account, enrol in a course, make a payment, contact us, or interact with our platform. We may also collect information automatically through cookies, analytics tools, and similar technologies as described in our Cookies Policy. We do not collect personal information from third parties unless you have consented to that collection.

Purpose of collection

We collect and use personal information for the following purposes: delivering course content and issuing certificates, processing enrolments and payments, providing student support and responding to enquiries, personalising your learning experience through AI-powered features, sending enrolment confirmations and course-related communications, improving our platform and course offerings, meeting our legal and regulatory obligations, and preventing fraud and maintaining platform security.

Lawful basis for processing

Under the Australian Privacy Principles, we process personal information where it is reasonably necessary for our functions and activities, where you have consented to the collection and use, where required or authorised by law, or where necessary to prevent a serious threat to life, health, or safety.

Data storage and security

Personal information is stored on secure, access-controlled servers. Our primary data infrastructure is hosted in Australia (Sydney region). We implement technical and organisational measures to protect personal information, including encryption of data in transit and at rest, role-based access controls for staff and systems, regular review of access permissions, and secure authentication mechanisms. Despite these measures, no method of electronic storage is completely secure. We cannot guarantee absolute security but are committed to protecting your information to the highest practicable standard.

Third-party service providers

We engage third-party service providers to support our operations, including payment processing, email and SMS delivery, cloud hosting and data storage, analytics and advertising measurement, and AI content generation. We only share the minimum personal information necessary for each provider to perform its function. Where a provider is located outside Australia, we take reasonable steps to ensure they comply with obligations substantially similar to the APPs, as required by APP 8.

Data retention

We retain personal information for as long as it is needed to fulfil the purposes for which it was collected, or as required by law. Account and enrolment records are retained for the duration of your access period and a reasonable period thereafter to support certificate verification and regulatory compliance. Payment records are retained as required by Australian tax law. You may request deletion of your personal information at any time, subject to our legal obligations.

Your rights

Under the Privacy Act 1988, you have the right to access the personal information we hold about you, request correction of inaccurate or incomplete information, request deletion of your personal information (subject to legal obligations), withdraw consent for marketing communications at any time, and lodge a complaint about how we handle your personal information. To exercise any of these rights, email hello@modernedu.com.au. We will respond to access and correction requests within 30 days.

AI and automated decision-making

Modern Edu uses AI-powered features to support learning, including an AI tutor, AI-generated content summaries, and AI-assisted assessments. AI interactions are used to personalise your learning experience and are not used to make decisions that materially affect your rights. AI tutor conversations may be retained to improve the quality of educational support. AI-generated responses are for educational support and should not be relied upon as professional advice.

Data breaches

In the event of an eligible data breach under the Notifiable Data Breaches scheme (Part IIIC of the Privacy Act 1988), we will notify the Office of the Australian Information Commissioner (OAIC) and affected individuals as soon as practicable, in accordance with our legal obligations.

Children's data

Modern Edu courses are designed for adults. We do not knowingly collect personal information from individuals under the age of 18. If we become aware that we have collected information from a minor, we will take steps to delete it promptly.

Changes to this policy

We may update this policy from time to time. Material changes will be communicated via email to enrolled students. The latest version will always be available on this page.
